Supplement to Trading Conditions Bremmer Boomkwekerijen BV 2020
All our sales and deliveries of products to customers located in the Netherlands are subject to the HANDELSVOORWAARDEN VOOR DE BOOMKWEKWEKERIJ IN NEDERLAND 2020 (HBN) with the exception of the articles below. By way of derogation, the provisions described below shall apply.
Article 1h: “freshly potted” means a plant that has been potted from open ground and shows no or hardly any sprouting roots. The term “pot-grown” means a plant that shows (some) roots on the outside of the root ball after removal of the pot.
Article 6 (Supplement): Samples intended for fairs will not be returned and will be charged at a value of 75% of the purchase price.
Article 7.2k: Bremmer Boomkwekerijen BV has the right to refuse purchases ‘on demand’ (for items of a seasonal nature).
Clause 8.2a: All plants in a C3 and C5 are provided with a photo label (=catalog price) by default at no extra charge. Hague conifers in C4, C7.5 and larger pot sizes are not labeled by default. If deliveries of C3 and C5 without label is desired, a lesser price of
€ 0,15. Conversely, a surcharge of €0.15 applies to deliveries of (hedge) conifers in a C4, C7.5 and larger with a photo label. These exceptions should be explicitly stated in the purchase agreement.
Section 8.2b: If pricing out the plants with sticker or trench label is desired, the prices according to the table below shall apply. If labels or stickers are supplied, they must be in our possession no later than 24 hours before delivery. This also applies to the data to be included on stickers or slot labels. Bremmer Boomkwekerijen BV accepts no liability for unintentional errors in the text or barcode.

Article 9.7 (Supplement): Transportation costs shall be borne by the buyer unless otherwise agreed in writing. If buyer has not arranged transportation, the plants will be delivered by carriers selected by Bremmer Boomkwekerijen. Transportation costs are billed separately.
Article 10.3 (supplement): If the buyer cannot guarantee delivery by April 15, Bremmer Boomkwekerijen BV is entitled to dissolve the purchase agreement. Seller shall give written notice of this to buyer.
Article 13.1: The payment period is 30 days. No discount may be deducted (in case of earlier payment) from the invoice amount unless agreed in writing.
Article 18.2: This provision does not apply.
Article 19.2: Costs for phytosanitary inspections and customs documents shall be borne by the buyer.
Deviation from these terms of business is possible only if agreed in writing.
